Filing of Return under Lokayukt if FC Funds received more than 10 Lakhs

Please suggest us if we received FC funds more than 10 Lakhs in a year. Should we file under Lokayukt?

    Dear Hemal,
    What Soma says is absolutely correct. Requirement of filings has been taken away through amendment in the original Lokpal Act and now only once the relevant rules are made in this regard, by the Govt filings will be applicable.
    Amended S. 44 reads On and from the date of commencement of this Act, every Public Servant shall make a declaration of his assets & liabilities in such form and manner as may be prescribed.
    In this regard govt had come out initially with a notification postponing the requirement of filing the returns initially to 31-12-2016 and subsequently it just stated that the return will be filed once the Govt prescribes the form and manner in which the returns are to be filed. Since Govt has not come out with the required procedure for filing the return, there is no need to file any return by anyone, be it an NGO or Govt servant or anyone else.       Let us introspect on a couple of basic and core questions? Shall we accept that all are not well with our sector? Do we believe in Volunteerism and claim we are Voluntary Organisations and therefore, claim certain tax concessions? When in the 80s, planning commission pioneered by Bunker Roy proposed a Council for Voluntary Organisations, leaders had knee jerk reaction and VANI was formed with the realization that instead of the government, we need some internal mechanisms? Was it taken forward genuinely or…???!!! Is getting huge funds a good parameter? We all talk of Peoples’ Participation and Gram Swaraj and lament on the government not doing enough. Then why not we practice to give hints and queue to the government to follow? Let such funds directly flow to the Panchayaths and such local self Governing Institutions? Why do we not trust them? We are registered as a Public Society. We need to depend upon and be accountable to the Public to avoid the Government poke. Are we willing? Why we are not keen on resource mobilization from the community or local Public or others? Let us respond with open heart and look within to find better solutions.

    Dear Hemal,

    There is no need to file any document/information under Lokayut. There was a circular issued by the GoI in December 2016 that they would come up with a set of guidelines on the filing with Lokayut. Such guidelines are yet to be issued. To the best of my understanding, none of the NPOs as on date have to worry about Lokayut filings.
