In the case of a registered family trust what is the role of the “author”?

If the original author is no more who will be heading the Trust?

Can the Managing trustee can be the chief functionary?

    please suggest us following points
    we have run FCRA project and march 2019 have completed also agreement has been finished but the funding agency without agreement want to give two month (April, May ) salary of the staff. and some of staff have left the organization and join other organization and received salary through FC account. please clear that can we received amount through the agency. can we give the salary in exiting staff. if no what rule of the FCRA.

    Author of a Trust is basically the settlor who has set up the Trust. It may be noted that settlor need not be a Trustee. In case original author has died and is no longer available, then changes in the Trust would become difficult, as Registrar before accepting any change normally would ask for presence of the settlor. Hence a new settlor can be appointed. This can be done by the Trustees by passing necessary resolution. Trustees can decide on the name of the settlor, again who can be a Trustee or an outsider.

    Your last question seems to be relating to FCRA. Since Chief Functionary post has been officially recognised under FCRA legislation only. Yes Managing Trustee can be Chief Functionary, but it should be intimated to FCRA Dept through FC6.
