{"id":1047,"date":"2012-09-07T07:28:44","date_gmt":"2012-09-07T07:28:44","guid":{"rendered":"http:\/\/blog.srr-foundation.org\/?page_id=1047"},"modified":"2014-03-21T07:48:20","modified_gmt":"2014-03-21T07:48:20","slug":"salient-features-of-multi-state-societies-registration-bill-2012","status":"publish","type":"page","link":"http:\/\/blog.srr-foundation.org\/?page_id=1047","title":{"rendered":"Salient Features of Multi-State Societies Registration Bill 2012"},"content":{"rendered":"<p class=\"MsoNormal\"><strong><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';\">Series -1<\/span><\/strong><\/p>\n<p><span style=\"font-size: 12.0pt; line-height: 115%; font-family: Algerian;\">1.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0 <\/span><\/span><strong><span style=\"font-family: 'Bookman Old Style','serif';\">Important Definitions (S. 2) <\/span><\/strong><span style=\"font-family: 'Bookman Old Style','serif';\">include Chief Executive Officer, Chief Financial Officer, Foreign Society, Inter-state activity among others, etc. <\/span><\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"text-align: justify; margin-left: .25in;\"><span style=\"text-decoration: underline;\"><span style=\"font-family: 'Bookman Old Style','serif';\">Re-registration of existing Societies under the proposed Act<\/span><\/span><\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"text-align: justify; text-indent: -.25in; margin-left: .25in;\"><span style=\"font-family: 'Bookman Old Style',serif;\">2.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0 <\/span><\/span><span style=\"font-family: 'Bookman Old Style','serif';\">Allsocieties undertaking \u2018inter-state activity\u2019 will fall under the category of<strong> Multi-State Society<\/strong>, and<strong> <\/strong>therefore would <span style=\"text-decoration: underline;\">require registration <\/span>under the proposed Act.<strong> Inter-state activity <\/strong>has been defined as any activity carried out by a society directly or indirectly for cash or for other valuable consideration from the place other than the place of origin including overseas transaction. <\/span><\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"text-align: justify; margin-left: .25in;\"><span style=\"font-family: 'Bookman Old Style','serif';\">\u00a0The definition of this activity will also include societies whose <\/span><\/p>\n<ul>\n<li><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';\">funds are in excess of a limit, to be prescribed, under FCRA, from NRIs, from grants &amp; donations,<\/span><\/li>\n<li><span style=\"font-family: 'Bookman Old Style','serif';\">receipt of immovable property from central govt. or any of its agency,<\/span><\/li>\n<li><span style=\"font-family: 'Bookman Old Style','serif';\">providing funds to another society or having membership of another society,<\/span><\/li>\n<li>having<span style=\"font-family: 'Bookman Old Style','serif';\"> foreign citizens or NRIs as members of the society.<\/span><span style=\"font-family: 'Bookman Old Style','serif';\"><br \/>\n<\/span><\/li>\n<\/ul>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"text-indent: -0.25in; margin-left: 0.25in; text-align: justify;\"><span style=\"font-family: 'Bookman Old Style',serif;\">3.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0 <\/span><\/span><span style=\"font-family: 'Bookman Old Style','serif';\">The Act is applicable not only to all Multi-state societies incorporated after the commencement of the Act but also all existing societies which would fall under the definition of \u2018Multi-State Societies\u2019 as per this Act. Hence it is quite likely that most existing Societies will need to re-register under the proposed Act.
