Recent Tax case decided favouring Charitable Trust

Printing of books held as incidental business activity thus allowed being exempt from Tax

In a recent ruling in case of Bhartiya Vidyapeeth (Pune) decided by Income Tax Tribunal in Jan 2012, it was held that when a Trust is found to be engaged in imparting degree courses to lakhs of students all over India, printing of books through its own printing press is an incidental business activity and shall be exempt from Income Tax under Section 11 of the Income Tax Act 1961. This ruling will be very relevant for a large number of NGOs, who are presently receiving notices from the Income Tax Dept. questioning several cases of activities which generate income for the NGOs.

Rental Income cannot be taxed just because volume of such income is very high

This decision also dealt with the matter of the charitable trust earning large amount of income from house property. In the impugned case, Income Tax Dept. (DIT (E)) did not give exemption benefit under Section 11 on the ground that the Trust’s rental income is very high and may not go well with its charitable status and on this basis sought to tax it under Income from House property or as Income from Business / profession. The Income Tax Tribunal held that such contention of the Dept. is wrong and further held that such income should be exempted from tax as per provisions of Section 11.

Skipping FOBs & subways, city prefer surface crossings

Public Works Department (PWD) conducted a survey, which shows that a large number of people prefer crossing the road on the surface rather than walking a extra paces to use a pedestrian bridge. Though constructing bridges with escalators and erecting tall iron railings on central verge of roads has helped to an extent, given a choice people avoid getting up and down a bridge.

Though Delhi has almost 100 pedestrian overbridges and subways, it witnesses a large number of pedestrian deaths every year. In 2010, 960 pedestrians were killed. The number came down marginally to 946 in 2011.

Despite civic agencies investing crores of rupees every year on subways and overbridges, Delhi’s roads continue to be a death trap for pedestrians. Encroachment of footpaths, faulty placement of pedestrian facilities and unscientifically built zebra crossing are reasons that make a pedestrian’s life difficult.

Soon, pedestrian subways at 7 more Metro stations

Delhi Metro has decided to construct pedestrian subways in seven of the Metro stations on the 27km long Jankapuri West –Kalindi Kunj corridor. The corridor will be constructed as part of Delhi Metro Rail Corporation’s phase-3 in the next four years. The seven stations include Munirka, RK Puram, IIT, Panchsheel Park, Chirag Delhi, GK Enclave and Nehru Place.

These underpasses will be of great use to pedestrians to cross the road, especially senior citizens and women. Major residential and commercial areas such as Munirka, RK Puram, Panchsheel, GK Enclave, CR Park and Nehru Place will benefit immensely. People will be able to cross the road to reach the bus stop or the market, without buying a Metro ticket.

This is wonderful initiative by Delhi Metro, and the pedestrian facilities will definitely bring huge relief to pedestrians.

CBSE to include chapter on Road Safety

The Ministry of Road Transport & Highways has planned to include a chapter on road safety in the Central Board of Secondary Education (CBSE) social science syllabus from class 6 to 10. The chapter aims to teach students how to cross a street safely and correctly. The chapter will also impart lessons on understanding the traffic signs and using zebra crossings, foot-over-bridges and subways.

 

 

 

The Central Board of Secondary Education has already sent a draft chapter to the government. Members of the syllabus committee will meet the ministry members and finalise the draft soon. Will also take inputs from the Delhi Traffic Police, International Road Federation, Institute of Road Traffic Education and Society of Indian Automobile Manufacturers and incorporate these to chapter.
