A Society with FCRA Registration for EDUCATION PURPOSES wants to create Education infrastructure with its own / FCRA funds and manage and run Education Institutions thro’ No FCRA Registration – Charitable Organisation. No transfer of assets. Is it permissible ?

Sir, the Query is : A Society “abc” is having FCRA Registration. It wants to create Educational Infrastructure required for a PG College. Can it lease to or allow the Infrastructure to be used by a non-FCRA Society “def” to run actually the PG College under its own name (non-FCRA Society) paying some nominal rent to FCRA Registered Society. Both are educational societies and charitable.
Your query is not clear. When you say, your society wants to ‘manage and run’ education institutions though they have no FCRA registration. If you need to transfer funds to these organisations than FCRA does not allow it. However if you can manage these institutions (like a project) without transferring funds to these organisations, then you can do it.
There is a provision (Rule 24) which allows upto 10% of FC funds to be transferred to such institutions by taking prior approval from FCRA Dept. You could try it, though there are uncertainties relating to approval.
