Pedestrian flouting rules, to be fined

In a bid to reduce pedestrian road deaths, the Delhi traffic police are getting stringent on those who trespass and violate traffic rules & regulations. Around 600 people were challaned for jaywalking in the capital in the past three days as part of a new drive by Delhi Traffic Police. 233 jaywalkers were prosecuted on Thursday while 195 were challaned on Friday. Yesterday, the figure was 154.

A total of 582 pedestrians were fined Rs 50 each from Thursday during the drive at six locations — ITO, Kashmere Gate, Anand Vihar, Rajouri Garden, Africa Avenue and Bhogal. The major reason behind pedestrian road deaths is that people don’t use foot over bridges and subways. With flouting traffic rules they jeopardize their life as well as create problem for others. In order to stop such practices, the police have started penalizing people. We hope a fine to the tune of Rs 50 will definitely help in reducing jaywalking in the city.

Distribution of Coupons, for Pedestrian Safety

Delhi traffic police have come out with a new initiative to promote Pedestrian Safety, by offering a cash prize of Rs. 5000 for those using Foot over Bridges. The initiative was launched on Jan 1 as part of Road Safety Week and received a huge response. About 19,998 coupons were distributed to the people during the week during peak hours. The coupons were distributed on FOB outside the Income Tax Office near Pragati Maidan and in Anand Vihar.

Not all pedestrians, of course, received 5,000 rupees for using footbridges over Delhi’s roads. The recipient of the prize was decided by a lucky draw. There are plans to extend the scheme and make it a monthly affair. According to government records, which show 534 pedestrians were killed on the capital’s roads in 2010. The initiative might save lives.

Transfer of fund outside India by NGOs

Hi,

Is there any Law enforced in India which prohibits  NGO based in India to make grant/contribution for a project to a foreign  individual or to an organization  of a foreign country?

Renewal of 80G / 35AC

I am informed that the Government of India has recently come out with a notification stating that the 80 G / 35 AC tax exemption certificate is not required to be renewed periodically. Please advise as some of our partner organizations are having problems.

Pelican system to ensure safe road crossings

The introduction of Pelican system at various red lights in South Delhi will ensure a smooth road crossing facility to the pedestrians. The success of the system however depends on the usage by the public. The Traffic Police has activated the pedestrian crossing signal at the AIIMS, GK-I turn, Press Enclave Road and C-Hexagon roundabout. Once a person pushes the button attached to the signal pole, the traffic light turns red for 15 to 30 seconds that allows the pedestrian to cross the road.

The technology was first introduced sometime back but it never really took off, mainly due to lack of exposure and poor maintenance. Now a system is introduced in NOIDA too for averting Pedestrian accidents, the district administration put the first pelican crossing in operation. We wish it better luck this time !!

TDS implication of a foreign national

Dear All,

I would like to know the TDS implication of a foreign national who doesn’t have PAN under the following categories.

1.       A foreign national who have joined an organization under PROFESSIONAL FEE, what will be the TDS impact?

2.       If he/she joined an organization under SALARY (Regular Staff), what will be the TDS impact?

QUESTION FROM A MOTORIST REGARDING PEDESTRIANS: Satyendra Garg, Joint CP Traffic

This question comes to my head EVERYDAY when I drive to wrk n cross Nehru Place area. Thr is a subway n a foot-over bridge on tht stretch, yet al pedestrians prefer to climb ovr the divider railing n suddenly jump in front of cars and buses. So here r the Qs which all citizens of Delhi deserve an answer fr–

  1. Are there any rules or guidelines to prevent pedestrians frm doing so while there r subways n pedestrian bridges available? 

  2. Wud the car/bus driver b booked wid same charges as nrmal if the pedestrian jumps in front n gets hit? 

  3. Who shud b held responsible of traffic jams caused by such menace?

  4. Shud a hand signal by a pedestrian b taken as their right to walk all ovr the road expecting evry vehicle to stop?

  5.  crossing, respecting the rights of pedestrians. If violated, DTP has rules to issue challans. Shouldn’t there be such rules fr pedestrians too fr violating driving space?

These questions were raised on Delhi Traffic Police Facebook page and as these questions concern everybody I thought I can respond in detail. It is a fact the city of Delhi has quite a number of Foot overbridges and subways and still a large number of pedestrians cross road at grade level, at times jumping the railings and always endangering their own lives. We conducted a survey of all FOBs and subways in the city and found many of FOBs and subways have serious problems. Most of FOBs do not have escalators making these difficult to use by aged and women. Many FOBs are not where these should be in the process making people cross roads at grade level. Conditions of many underpasses are not very good and because of bad lighting etc security of women remain an issue apart from issues like location of underpasses and related issues. 

In effect what is happening is people in general are crossing roads whererever they find convenient and many a times getting knocked down by vehciles also. This phenomena raises certain issues: We do not have sufficient crossings for people on most of the roads, wheverer facilities are there, there are limitiations of placements, issues of escalators, safety, bad conduct of pedestrians themselves in not using these wherever these eixst etc Also there is great deficiency in road safety awareness in people. As a consequence maximum casualties on roads are of pedestrians. 

Now the questions: Yes, pedestrians should use FOBs and subways wherever these are available. Regarding responsibility in case of accident, till now responsibility remains of the motorists even when pedestrian is using grade crossing despite facilites but this can be taken up during trials. Reasons why this is not a viable proposition is because at most of the places pedestrians facilites are not there. As on date motorist is booked even if pedestrian jumps in front of him, though defence can be taken in trial stage, as told earlier. Normally a hand signal should not be considered valid when pedestrians facility exist but as on date if accident happens motorist will be booked for the offence.

As on date in Motor vehicle act there is no provision for prosecuting pedestrians for crossing roads at non-specified locations for the simple reason that MV Act deals with offences by vehicles. There is a provision to book pedestrians for jaywalking but fine is so insufficient that prosecution becomes meaningless and process is cumbersome.

I think the note will not satisfy the conscientious motorist about ground reality but we should also keep in mind the penalty in terms of injury or death is of pedestrian if he commits mistake. Yes harassment is to motorists also but we are also aware that many motorist do not keep others safety in mind, leave alone pedestrians.

Opportunities for NGOs

The finance ministry is pulling out all stops to further financial inclusion. The ministry has asked banks to tie up with NGOs as business correspondents in a pilot project to lend to self help groups (SHG). As a result lending rate for SHGs may go up, reports CNBC-TV18’s Gopika Gopakumar.

The finance ministry is looking at newer ways for financial inclusions. The ministry has proposed a pilot project where by banks will tie up with NGOs to offer help to SHGs. As business correspondents, NGOs will be responsible for borrowers’ accounts and maintaining recovery of loans. In return NGOs will get a margin of 6-7% for offering their services.

Banks, therefore will have to offer loans to SHGs at a higher interest of 18% as against the current 14%.  Separately, banks have been asked to convert some of their term loans into cash-credit facility for SHGs. The cash-credit facility will act as a running account for an entire group and individual borrowers can avail their loans when required.

However, bankers are worried that this may hit the repayment culture among the SHGs because under the cash-credit facility, borrowers need not pay the entire loan amount but only service the interest on a monthly basis.

ACCOUNTING FOR GRANTS

Dear friends,

May I raise a related but different question for expert advice?

Grants need not be shown in the Balance Sheet excepting in Income and Expenditure Statement.

That way one can legally circumvent the tax and or ceiling limitations on unspent balances

At the financial year end. The MOU between the funding agency and the recipient clearly states that the grant is for a specific work(s).

Is such treatment correct or does it invite special treatment by MHA!

Query: Is it ok, if we deposit the loan amount received from the field staff in the FCRA bank account

Hello Every one,

I have a question, regarding the amount to be deposited in the FCRA bank account.

When we give advance or Loan to the field staffs from FCRA bank account and when they repay this amount, we need to deposit this amount in the FCRA bank account.

Kindly confirm if this practice is fine.
