FCRA fund for seminar.

Can i received FCRA fund from individual foreigner for training/seminar fees and deposit in FC Bank account

    Dear Friend,

    FCRA funds can be received provided you are registered with the Home Ministry either permanently or after getting prior permission. You should make necessary application to the Home Ministry.

      1. Yes.
      2. If your total FC is Rs 1 crore or more than disclose a summary of total receipts & utilisation. This has to be there at least for one year.

      There was a draft rule proposed, that all FCs would need to be disclosed on websites, however till date final rules have not been released, so above position as mentioned under 2 stands.

    Dear Manish,

    Any fee received for seminars / conferences from foreign participants is exempt from FCRA (see Explanation under Foreign Contribution under S. 2 (h). This has also been explained under FAQs. So you can accept fee for seminar / conference from any person including a foreigner. You should not deposit this amount in FCRA A/c, since it is not FCRA money.

      since it is a seminar fee, service tax would be applicable. What is the implication of that ?

        Service Tax is an independent tax and has to be seen in that context. Presently if total turnover of taxable services is less than Rs 10 lakh in a FY, Service tax will not be applicable.
