Latest news on FCRA Renewal

This is to bring to all SRRF Dialogue members attention that there is finally some movement on pending FCRA renewal applications.

Today SRRF received an intimation from senior FCRA official informing us that FCRA renewal process is likely to be initiated in Nov’2015. This is good news for all those waiting for some news on FCRA renewal.

However we still are not aware of the process to be followed. There are many questions in the mind of agencies who have applied for FCRA renewal, like whether it will be an online process, if so whether fresh applications would need to be filed. What would happen to all the hard work done in preparing the past applications, etc.

While welcoming the Dept’s initiative in intimating about future plan for renewal of FCRA applications, however we do request the Dept to provide further clarity on the process too.

    Thank you SRRF Dialogue members for an overwhelming response. Though in all honestly it also reflects the NGO Sector’s anxieties fermented by FCRA Dept’s lackadaisical approach to the whole Renewal process.

    Why they did not put the renewal process in place, when Rules required NGOs to apply 12 months or 6 months before the renewal date (depending on length of projects being implemented) ?

    Considering so many anxious queries we tried getting time from the Dept. but there has been no response. This is the typical attitude we all have to deal with the FCRA Dept. Though the Act says the Dept would give FCRA registration within 90 days, but we all know that promise is hardly ever fulfilled, we all wait for months and in several cases years, before we get any response from the Dept.

    So let us be patient and hope the Dept would soon come up with details of the renewal process and would keep in mind that a very large number of NGOs have actually already complied with its existing laid down procedures.

    FCRA department will ask any thing.As per the new FCRA rule we supposed to keep the record for last six years.Every organisation has to provide last six years details. In the excel make the statement.

      Dear Mr. Roshan Kumar,

      If your organisation has FCRA registration prior to 1st May 2011, then the last date before which your FCRA renewal application should reach the FCRA dept. in Delhi by post is 31st October, 2015. If your registration is after May 2011, then you may add 4 years 6 months to the date of registration and arrange to send the application before that date.

    Many people are having apprehension that our demand draft which we submitted along with application for renewal must have lapsed by this time. What will be the scenario in such situation. Whether we have to submit a fresh DD?

      They would have segregated the drafts from the application and deposited in the Govt’s account as and when they are received. So you need not worry that the drafts would get lapsed.

        Our organisation has applied well in time for FCRA renewal and sent the DD. However the DD has still not been encashed. The way there is no movement on this by the department seems to show disregard indifference for the voluntary sector. Let us see!

  8. Since systems in FCRA division is still not clear, tensions are going to escalate in November 2015 for NGOs dependent on FCRA funding. For NGOs’ that have applied physically, would be good to check whether the DD submitted has been cleared or not and keep the record as a back up.

    We have applied with hard copy and a demand draft of Rs 500/- as mentioned earlier, will that stand or we have to re-apply on line?

      I would like to get some clarity on year wise FCRA receipt and expenses required As per the FC 5 for renewal of FCRA registration.
      Please guide on the following:
      1. FC details for how many years required for the renewal, if the organization that was registered under FCRA in 1984?
      2. If the organization have not received any FC since over a decade, but now want to renew the FCRA? what information is required?

        1. The requirement by the dept is the receipt and utilisation details of FC received from the year of registration. At least you may give the quantum of amount received and utilised year wise and also the prupose for which it is received / utilised.

        2. Make a chart giving the year wise receipt and utilisation and show nil in the years in which you have not received any FC.

  13. Do we know what criteria will be applied and by whom for renewing or not renewing the FCRA?
    Do we know what the exact process is ?
    Has the criteria been discussed with civil society orgs or with umbrella organisations like VANI?
    Is there an appeals process?
    Is there a way of knowing all this – for officials to go public about how they are going about the process right now it is very opaque.
