I am a member of a Society,registered public trust in India.
Some members of the Society, have collected funds in US and Netherlands Accounts ,for a building renovation project in India.
However,they are not transferring the accumulated amount to Indian FCRA Account.
I wanted to know any legal recourse available to us,so that the funds collected can be brought back to India.
Also,would like to know where any breaches in Indian legal system has happened and recourse.

Funds collected outside India, one will need to examine the legal jurisdiction. Was it under a contract ? If no, then check under what pretext funds were collected from the donors there. If they have been cheated, or what has been stated not being fulfilled, then donors could take legal action in the country. In India also if it is under explicit contract only then action be taken depending upon where the jurisdiction of the contract lies.

If it is a Trust, the word society is invalid. What members are they? Institutional? Individual? General body but not Board members? Only Board members? NRIs? Foreigners? Whose foreign accounts? Very sensitive question, Sir. Hence the details are required. Any proof of the purpose for which funds were mobilised abroad and credited into specific accounts of the individuals? Any authorisation by the Board to do so?
