FCRA Dept has finally announced the Renewal Process for FCRA registration. Renewal process as expected would be undertaken online. Thus all persons who have already applied or even those who have not applied would need to apply online through FC3. Last Date of application is 15th March 2016.
Fee for Renewal of Rs 500/- would need to be paid online through FCRA Payment Gateway. For persons who have already sent their DD/cheques are likely to receive these back, unless your name is appearing in the list given by FCRA authorities. As per FCRA Act 2010, Sec. 12(6) states that “Every certificate of registration granted to a person under the Act shall be valid for a period of five from the date of its issue.
Hence certificate expires at the completion of five year from the date of issue. Application for renewal should be made prior to 6 month of expiry of registration.

FCRA online renewal is not uploading the documents. It instructs .JPG files for signature and seal, all others in .pdf format. It gave a message saying ‘please upload PDF files. Then I changed all files to PDF and uploaded the same. It gave the message ‘ Use JPG for signature file’. This happened thrice today.
It has been mentioned clearly that the signature and office seal should be in JPEG format only in specific KBs and other documents in PDF format, also in specific MBs. The system has been set in that way. Where is the difficulty in converting the required documents and uploading? Most of us have done in that way only successfully

We, Aseema Charitable Trust, Mumbai (registered under FCRA ) have encountered a technical problem while filling the payment option of the Online Renewal form.
On 23 February 2016, we made the final submission online [ file no. II/ 21022/ 68 ( 0467 )/ 2016- FCRA- II ] and proceeded to check the online payment option. However, when we actually checked the site for making the online payment on 25 February 2016, the following message has been appearing on our online application page:-
Your application is waiting for payment status from bank. Please wait 4-7 working days for status updation
We would like to inform you that we have not yet made the payment. We urge you to guide us with the online payment process immediately.
We had also written to the FCRA helpline ( support-fcra@gov.in & clsharma@nic.in ) about this issue on 25.02. 2016 and on 29.02.2016. But so far, we have not received any feedback from them.

We are a registered body. We had tried to renew online in November 2015 . For some reason our renewal form refused to upload. So we sent a hard copy with the renewal fee. We did not get any reply.
We tried again to renew our registration online on 6th of January. But it refused to accept it saying we are not even registered. So we thought we should register first then try renewing it. So we registered filling the form and sent a wire transfer of the necessary money. We have not yet got any intimation. We would like to know how to proceed.
We have also been regularly filling our returns but our trust does not seem to feature in the names of the Organisations that have filed returns.
Possibly you have not been filing online returns, hence your data is not available online system. Suggest take help of an expert to help you undertake compliance, if not already undertaken. Considering time is on short lease, you will need to rush.

We have been trying to submit FC 3 form on MHA website and are facing the problem in filling clause no 8. All other information has been filled in but in this clause check box are not being ticked. We are an independent Indian registered organization with no connection ever with any foreign agency / not a branch of any foreign based association but when we tick NO ; system is not accepting it and submission is getting failed even after repeated attempts.
When we go for final submit page it says fill the EC conduct and other details and when we check there it says “SELECT AT LEAST ONE (A) IS A BRANCH/UNIT ASSOCIATION OF A FOREIGN BASED ORGANIZATION”
Kindly advice us how to proceed.

This Issue is Resolved Now. We had sent a query to MHA to which they responded promptly advising us to use Google Chrome Browser for filling up the form. Earlier we were using IE in which check buttons were not getting marked . After shifting to Chrome , it was a smooth process and we submitted the FC 3 form on 22nd.
Would advise all members on this forum to use Chrome while filling MHA forms.

There was an error in our PAN No. which was not registered under societies. Now we have rectified the same and obtained new PAN No. On which link / site we should intimate FCRA dept. please help us.

While PAN is requested at the time of registration, it is nowhere referred to again. The information is not asked either at the time of renewal. Even FC6, which is basically for intimation of various changes does not cover PAN. However if you wish to inform FCRA Dept. of the same just send a letter and send the same both by email as well as hard copy. Keep evidence of posting the same. There is no requirement to have it intimated, but always better to intimate the Dept. if there is change in any information which you have submitted earlier.
We are from Samagra Grameena Ashram, Udupi district, Karnataka State working for tribal in Karnataka. Filing the renewal of FCRA we do have the netbanking facility to our organisation bank account and applied for the same. In case of no internet banking can we make the payment through an individual debit/credit card.

ODMP is a registered NGO REGISTERED under foreign contribution (Regulation ) Act and have been regularly submitting FC return online. but from 2012-13 we are submitting the above return only in hard copy format . The reason ascribed is going down by the site indiatimes.com wherein we have been listed as odmpprogrammes@indiatimes.com.

Does print out of Intimation of Utilisation account to MHA online has any acknoledgement on the page like stamp or URL at bottom of the page from were we have taken this print because we have submitted the Intimation to mha and same has been submitted to bank but bank is asking for the such acknoledgement
No Chirag, presently there is no such authentication.
While ‘Renewal file’ gives MHA file no., ‘Annual Return’ gives date of submission. Ideally date of submission should have come on intimation applications too.
Only authentication is the water mark of ‘Ministry of Home Affairs’ written across pages which have been submitted to MHA. Further the application also has digital signature ans seal of the organisation, which has submitted the same.You could argue on that basis.

The list you mention contains names of those NGOs whose DDs have been already deposited in the bank and so they need not pay the fee of Rs.500 online once again. But they have also to re-submit renewal application online.
We do not wish to confuse you. Only good part is that you do not need to again pay fees of Rs 500/-. As Shiva has already stated just file your application for renewal online. Forget the earlier application that you filed.

3. Nature of Association
Our trust is registered as Religious and Educational, can we tick social and economic also as we have social and economic activities too.
4.a. Main Aims and Objectives
Should we mention ONLY the aims and objectives which are in the trust deed or other activities which fall under the last objective which reads as follows “ Generally to do all other such acts, things and matters as are conducive to the general objectives of the trust”. Like activities related to social and economic.
5. Governing Body Details
g. If the trustee is not related to any one then it falls under OTHERS, in that case what can we mention
g.If a trustee is in staying in USA having Indian Passport should we mention address, occupation, Residence phone and mobile no of USA ? If a trustee is rendering social service from residence without having an office in that situation should we mention office address same as residence address.
7.e. What DETAILS must be provided when a trustee is also a trustee of other organisation

5g. It is surprising that for declaration of relationship with other members, ‘None’ option has not been given. There are other in fact three options of ‘Other/Others’ Use option Others, it further asks details mention ‘None’ there.
5g. Trustee staying in US, while you can give US residence datails, however it would be better to mention same address as included in his/her Indian passport.
Office Address: If ‘no office’ no need to mention office address.
7. Name of the Organisation, address (perhaps District & State can be mentioned) and if possible position held in that organisation.

In FCRA renewal, there is a question which is as follows:
Whether the trustee is a current key fuctionary of any other association ? if so? provide details of name of association, fcra no and Registration no.
in this concern few trustee had following questions to me (I am accountant of the trust)
1. Do they have a definition of ” Key Functionary”?
2. When they say association , what do they mean? NGos, Trusts?
3. Is the information required only if i am key functionary? (Invited trustee for 3 years raised this question)

Key functionaries are the office bearers in a society or the Trustees in a Trust. The dept. wants to know whether any of the Trustees in the organisation’s Trust Board is also a Trustee in another Trust or an office bearer in another Society? The word association refers to any Trust, Society or Sec.8 Company. The information needs to be provided only if a particular Trustee is holding a position in another NGO also. Otherwise, you may mention ‘No’ in this column.

1. Usage of term ‘Key Functionary’ is a new term used in online forms. Earlier annual return (FC6) required ‘Chief Functionary’ to sign the Form, however now FCRA Dept is using the term ‘ Key Functionary’. FCRA rules or the Act does not define this term, therefore it has to be understood in terms of daily parlance. In this regard, I agree with Shiva below that ‘Key Functionaries’ can be used for identifying ‘office bearers in a society’ or ‘Trustees’ in a trust.
2. The term ‘association’ has been defined under FCRA Act 2010. It is termed as ‘association of individuals’ including a society and any other organisation. Generally association under FCRA have been considered for what we call organisations for non-profits and include Trusts, Societies as well as S.8 Company.
3. My suggestion is that in case any of the office bearers if a ‘trustee’ or on Board of another association should be disclosed as Key Functionary. But if he is just a member, which does not form part of the Board, then we need not disclose that association. For example, if a person is just member of an organisation as part of ‘General Body’ then his/her name should not be included as key functionary.

We already send hard copies for renewal of fcra in May 2015 along with Demand Draft. Still now, there is no response from Ministry side. So, please help me what I have to do for renewal of FCRA.

I am submitted FC -6 Returns for the year 201-15 in the month of May 2015

Mr Reddy, while you do not need to resubmit your annual return (earlier FC6) now FC4, however you will have to resubmit renewal application online in Form FC3.
My organisation has a permanent FCRA number. Will organisations with a permanent FCRA number also have to reapply?
Please note that now FCRA No. is no longer permanent. It is valid for 5 years from the date of issue. In case your FCRA registration letter was issued before 1 May 2011, then it has now become due for renewal. You can get sufficient information how you can renew on this blog or FCRA Dept website.

Go to the link https://fcraonline.nic.in/home/index.aspx. You have to select and fill FC-6 form. The Required Documents button will tell you what are the documents you have to keep ready before filing the FC-6 form online. Keep them ready, fill the FC-6 form online, upload the required documents and final submit for effecting change in the bank account.
It is not clear whether already you have an account (for local transaction purpose) and want to convert it into FCRA account. Have you already got FCRA registration? In the FCRA order, they would have mentioned the details of designated FCRA account. If you want to change this account to a different bank, you can do so and intimate within 15 days of such transfer, as per the latest amendments. You have to get certificates from the existing bank and also from the new bank about the existence and transfer of the account (to the new bank). You have to upload both the documents along with FC-6 application.

Please write me present status of Social Aid for the Rural area
One of our Director wants to resign, but he is unable to do so because he was part of the board during FCRA registration. In case he resigns the ratio of key managerial positions becomes less than 50%. We have applied online for renewal of FCRA registration. Now he wants to resign from the post of Director. Is it possible and will this affect our FCRA renewal process. If possible, please let us know the procedure.
There is no requirement that if changes are made in the Board, after applying for renewal, whether same would need to be intimated. However since you have to intimate changes in Board within 15 days, you cannot avoid intimating the Dept. of this through FC6. This aspect should also be also brought to the knowledge of the FCRA Dept.
However practically it would be better if the concerned Trustee continues till disposal of your Renewal Application and then can resign, which then you can intimate within 15 days.

No, requirement of filing hard copy has been done away now.
Now FCRA Dept launched new website for fcra renewal and accordingly all organizations even those who have already applied in hard copy format are required to re-apply online. But FCRA Dept has mentioned to re-apply for those for whom last date was 31/10/2015 means before six months category
There is no clarification regarding who applied in the month of April 2015 i.e.before One year category for multi year projects are going on and also not clear about their D.D. since in the list declared by the FCRA Dept there are no details of who have applied in the month of April 2015

Yes Prasad, all organisations who are due for renewal now have to reapply, whether you filed before 30th April or 31st October.
Infact Rule 12 (3) which was for multi-year project organisations has been omitted after new amendments.
i have done all FC receipts (Donor wise) and payments transaction in FCRA online side on 11 December 2015 and finally re-checking the filed data on FCRA side but that time suddenly showing on the side (Due to FCRA side under maintenance side will be open 14 December, 8 PM),

Bhuwan I think you are talking of Annual Return and not renewal. You will need to do it again, since the Annual Return Form itself has undergone changes. Now the Form is FC3 and not FC6. However suggest do not rush into it as the last date has now been extended to 15th March 2016 (since the website is frequently undergoing changes).
