Filing of FCRA ‘Nil’ Return

Dear Dialogue Members,

We have grant FCRA registration on 10.03.2015 and during the FY 2014-15 not received any foreign contribution, in this regards our quotation is “NIL” return (FC4) file for FY 2014-15, it is mandatory or not.

if it is mandatory but in the online FC4 without all documents attachment (Audited Statement,CA Certificate,Bank Statement which is not available for NIL Foreign contribution) not completed and not accepted.

Please suggest

    I think we can not go further for final submission of FC return if we do not upload all documents which are asked by FC department. And in case of nil return there will be no Audited statement. So in absence of Audited statement we can not go further. Advice what to do.

      Dear Sanjay,

      I understand problem that you are facing. As a practical wayout, what I suggest that in place of audited statement, please attach declaration that the Chief Functionary has to give.

      On a different note I feel, nil returns will be few and far between. Since most organisations would have saving bank account and they would earn interest on the same, even if it is small.

    Practical problems with the website continue. These are not legal issues.

    I think you have very good responses. Have you tried it out ? What is the current status, please share how you solved the problem.

    Dear Sunil,

    Please note that even if you have not received any FC funds during the FY, still you have to file the annual returns as “Nil Returns”. Secondly you do not have to send the audited financial statements with the auditor’s certificate in case of “Nil Returns”.

    Also, a return is considered “Nil” only if the receipt as well as the utilization of the FC funds is Nil. If there is no receipt but some utilization is there, then Nil returns with financial statements has to be submitted online.

    Dear Sir,

    We have filed NIL return in the earlier format on-line during 2013-14 against our society as we received the registration towards the end of of financial year (Feb’14). Of course in the new format I am not aware as I didn’t have the requirement.

    Dear Mr. Sunil,

    Following is the extract from FAQs of he FCRA dept. site:-

    “Submission of a ‘NIL’ return, even if there is no receipt/utilization of foreign contribution during the year, is mandatory. However, in such case, certificate from Chartered Accountant, audited statement of accounts is not required to be uploaded.”

    So, declaration of NIL foreign fund receipt by the Chief functionary and also copy of bank statement till 31st March 2015 are to be uploaded along with signature and office seal in jpeg formats. The bank statement is to confirm that you have not received any foreign fund during the financial year and also there is no bank interest accrual. If you correctly fill all details with nil receipt in the initial pages, the documents uploading page will require the uploading of the above two documents only.

    You may try this and still if your find some difficulty, you may communicate that to the e-mail ID–support-fcra@gov.in, who will give a prompt reply.
