12A and 80G Approval

Dear Sir,

We have received an order giving provisional certificate for 12A and 80G.

Could you please advise how long it takes to get the original certificate ?  Or, this would suffice for next 5 years.

    Legally ‘Provisional Certificates’ are applicable only in case of new entities, applying for first time. It seems that there has been some confusion at the Dept level (maybe because many of these approvals get generated directly from the system itself), whereby some of these approvals showed word ‘provisional’ initially. Orders have been issued in the specified Form format. Under the words ‘Form 10AC’, it states ‘Order for Provisional Approval’.

    My understanding is that generally these have been issued against some of the applications made during initial period. The Order includes the word ‘Provisional’. However most of the Orders being issued now do not contain the word ‘Provisional’. In fact even initial mails informing the assessees about the issue of order had words ‘provisional’ included in the message.

    You could write to the Dept, informing about this, or just check the Income Tax web-portal, the Dept may have updated the correct order.
